Debt management

As a reaction to the worldwide crisis of the financial markets in 2008, EXPOL created its unit specialised in the management of outstanding debts, which, apart from classic and special private investigation tasks, also performs debt collection tasks for financial institutions, economic companies and private entities, adjusting to their requirements.

EXPOL debt collection tasks:

  • Debt collection through personal visits;
  • Debt collection through personal visits and asset research;
  • Debt collection through legal consultation.

The high level of general and professional theoretical knowledge, professional experience and specific education system of EXPOL staff makes our company suitable for representing our contractors’ interests even among the difficult economic circumstances effecting our society, in the most efficient way, at the same time, always according to the legislation in effect, as well as our contractor’s interests, and keeping their good reputation.

We are convinced that out of all the debt collection techniques, one of the most efficient methods is the debt collection process combined with personal visits.

Within the frameworks of these tasks, EXPOL undertakes to visit the clients in person in order to validate the contractor’s righteous claims, and contribute in the settlement of the financial claim, the facilitation of the payment, as well as, in case it’s necessary, concludes instalment payment agreements and acquires debt recognition declarations.

Advantages of debt collection combined with personal visits against every other debt collection procedure:

  • personal and direct communication with the clients;
  • the importance of the debt can be well perceived by the client;
  • in the client’s payment rankings, our client’s debt settlement obtains a more favourable position;
  • any possible misunderstandings can be clarified;
  • providing precise information and personalised consultation;
  • due to a necessity for the avoidance of further similar unpleasant situations, conclusion of payment agreements, prevention of the escalation of the debt.

In the case of non-recoverable claims or those that can be recovered only with extreme difficulties, as well as in the cases where other collection companies have not succeeded, EXPOL performs so-called second-round or complex debt collection tasks.

This activity includes a full debt collection process through personal visits; however, the complexity of the investigation is provided by the fact that this task is accompanied by:

  • the investigation of the clients’ personal and financial circumstances, as well as that of their financial solvency;
  • preparation of environmental studies;
  • asset research;
  • as well as finding the place of residence of debtors whose location has been unknown.

In the case of asset research, we investigate both movable and immovable properties, to which the claim can be spread in the course of a judicial or enforcement procedure (e.g. vehicle identification, real estate’s topographical number etc.)

As a result of the investigation, it is not only possible to collect or decrease the debt but also, according to the acquired extra information, the contractor can bring a justified decision about the further measures concerning the debt. (e.g. implementation, selling, discounting etc.)

This is the most complex and most professional debt collection task, implemented for our clients explicitly in the cases of complex procedures requiring great professional and legal preparedness.

The debt collection process also including elements of the debt collection activity along with asset research is implemented by a team that consists of specifically trained lawyers and detectives:

  • EXPOL lawyers elaborate the most efficient methods of debt management by taking into consideration of the unique features of the contractor and the assignment.
  • Following the personal consultations, the investigation team collects all the information meaning the bases of efficient debt management by lawyers’ surveillance and coordination.

Our staff does not only place great emphasis on lawfulness and professionalism but also uses every possibility that could lead to results. This type of creative application of law takes place in two phases:

  • The first part of the work process is the exploration of possible solutions;
  • Afterwards, along with consulting the contractor, the implementation of further measures takes place, if possible, the debt is collected and further procedures are implemented. (e.g. occupation, assignment, public warehousing, initiation of substantive criminal prosecution etc. ...)
